Seminar: How to handle cross-border child abduction procedures? Novelties brought by the recast Brussels IIa Regulation.
The seminar will deliver in-depth insights on the highly specialized topics related to EU child abduction cases and will be carried out by leading practitioners tackling the crucial novelties brought by the recast Brussels IIa Regulation which will be applicable as of 1 August 2022.
In this vein, the training will focus on jurisdiction, abolishment of the exequatur, harmonized enforcement rules, taking the return decision.
The relevant case law of the Court of Justice of the European Union and the European Court of Human Rights will be specifically discussed in the context of intra EU child abduction cases with reference to the right to a fair trial and the right to respect for private and family life.
The training presumes general familiarity with EU law and international family law.
Throughout the discussions specific efforts will be made to blend the theoretical approach with practice oriented learning outcomes through polls, breakout rooms and a workshop session.
